These Terms of Service govern the use of services provided by Cakie Pty Ltd (ABN 99 695 985 534). By engaging our services, placing an order, or using this website, you agree to be bound by these terms. If you do not agree, please do not use our services.
Cakie Pty Ltd provides artisan confectionery services including custom cakes, pastries, desserts, catering, and delivery as described on our website. All services are provided subject to availability and agreed timelines.
Orders are confirmed upon receipt of a written quote acceptance and payment of the required deposit (typically 50% of the total). Full payment is due no later than 7 days prior to the event or delivery date. Payment may be made via bank transfer or as otherwise agreed in writing.
Cancellations made more than 14 days before the event date will receive a full refund of the deposit. Cancellations made between 7 and 14 days before the event will receive a 50% refund of the deposit. Cancellations made less than 7 days before the event are non-refundable. Cakie Pty Ltd reserves the right to cancel any order with a full refund if unforeseen circumstances prevent fulfilment.
Changes to confirmed orders must be requested in writing at least 7 days before the event date. While we will endeavour to accommodate changes, we cannot guarantee all modifications and reserve the right to adjust pricing accordingly.
Delivery and setup fees are quoted separately and must be confirmed prior to the event. Cakie Pty Ltd takes reasonable care during delivery and setup but is not liable for damage or loss once goods have been delivered and signed off by the client or their representative.
We are happy to accommodate dietary requirements where possible. However, our kitchen handles common allergens including gluten, dairy, eggs, nuts, and soy. We do not guarantee that any product is allergen-free. It is the client's responsibility to inform us of all dietary requirements and to communicate allergen risks to guests.
All designs, recipes, and creative concepts developed by Cakie Pty Ltd remain our intellectual property. Clients may not reproduce, replicate, or distribute our designs without prior written consent.
To the maximum extent permitted by law, including the Australian Consumer Law (ACL), the liability of Cakie Pty Ltd for any claim arising out of or in connection with our services is limited to the total amount paid by the client for the specific order giving rise to the claim. We are not liable for any indirect, special, or consequential losses.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms is intended to exclude, restrict, or modify those rights. If our services fail to meet a consumer guarantee, you are entitled to a replacement, refund, or compensation as provided under the ACL.
We reserve the right to terminate or refuse service at our discretion, including in cases of abusive behaviour, failure to pay, or breach of these terms. In such cases, refunds will be assessed on a case-by-case basis.
These Terms of Service are governed by the laws of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
We reserve the right to update these terms at any time. Changes will be effective immediately upon posting to this page. It is your responsibility to review these terms periodically.
